The lawyers for two RCMP officers who confronted Taser victim Robert Dziekanski at the Vancouver International Airport in 2007 are appealing a British Columbia Supreme Court decision that confirmed the Braidwood Inquiry can make findings of misconduct against them.
The lawyers for constables Bill Bentley and Kwesi Millington filed documents in the British Columbia Court of Appeal seeking to have the lower court ruling by Justice Arne Silverman overturned. In his June 15 ruling, Silverman upheld the right of inquiry commissioner Thomas Braidwood to find misconduct by the four RCMP officers that were involved in the Taser confrontation. The officers' position is that the Braidwood inquiry, which is probing the death of Dziekanski, cannot authorize finding of misconduct against members of the RCMP. Alternatively, the notices of appeal filed by the two officers seek a permanent injunction to prevent the commission from continuing any proceedings against Millington and Bentley or making any findings of misconduct until 60 days after the British Columbia Court of Appeal rules on the matter.
So far, no date has been set for the appeal court to hear the appeal. The Braidwood inquiry adjourned until September 22, 2009 after an e-mail from a senior commanding RCMP officer surfaced, which said the four RCMP officers had discussed using a Taser against Dziekanski before arriving at the airport. The e-mail, written by Dick Bent, contradicted the evidence of the four RCMP officers at the inquiry, who testified they had no discussions prior to arriving at the airport. Braidwood said he was appalled at the last-minute disclosure of the e-mail and said it needs to be investigated... so he adjourned the inquiry for three months.
A 72-year-old woman who refused to sign her speeding ticket got out of her truck and dared a deputy to shock her with a Taser.
So, he did. Video released by a Travis Country Constable's Office shows Kathryn Winkfein hitting the ground and moaning while the shocks went through her boy after the May 11 confrontation with Travis Country Sheriff's Deputy Chris Bieze.
The woman was stopped for driving 60 mph (or 96 km/h) in a 45 mph (72 km/h) zone just west of Austin, Texas. A dashboard camera in the deputy's car shows the 4'11" woman refusing to sign her speeding ticket, getting out of her white pickup truck and cursing at the deputy constable.

"If you don't step back, you're going to get Tased," Bieze says.
"Go ahead, Tase me," Winkfein says. "I dare you."
"Put your hands behind your back or you're going to be Tased again," Bieze yells, and then hits her with another jolt.
Winkfein previously told Austin television station KTBC that she didn't believe she deserved to be shocked.
"I wasn't argumentative, I was not combative. This is a lie," she told the station.
Today, the RCMP was questioned today on its new policy that no longer prohibits Mounties from firing multiple Taser shocks at suspects. Instead, they will leave it up to individual officers to make their own judgement calls.
Commissioner William Elliott was grilled by the House of Commons public safety committee, where several members accused the RCMP of watering down rules that govern the use of the controversial weapons.
That's a shame...

Well, now, the cops involved may face charges, soon.
Forty-year-old Robert Dziekanski died in October of 2007 after being hit five times by a Taser, while a bystander filmed the encounter with his cellular phone.
A Saskatchewan man who says RCMP officers Tasered him 14 times, including one in the ass-crack, is suing the Attorney General of Canada.
Bruce Janvier has filed a lawsuit in which he paints a disturbing picture of the events in an incident in La Loche, Saskatchewan on April 28, 2007.
Meanwhile, the RCMP is telling a different story. Janvier alleges that he was arrested for no lawful reason while walking alone. Yeah... right. He says he was then handcuffed and taken in the van to the RCMP detachment. He claims cops also pulled his pants down. Janvier's claim says cops "forced the plaintiff to the ground and, without justification, administered a minimum of 14 Taser shots to his person, including one in the crack of the plaintiff's buttocks. The pain of the Taser shots caused the plaintiff to lose consciousness."
The Attorney General's report says cops only Tasered the guy three times. It says Janvier mooned cops on the street, and those officers then stopped and questioned him. They also determined that he was drunk as he said he was Elvis Presley and asked the constables not to kill him.
You know what's a great form of entertainment? Police brutality! Sure, it may be bad for the person who is getting their ass whooped. However, it provides a form of entertainment, such as an episode of COPS.
Anyway, remember when cops in Montreal shot and killed a teen last summer? Anyway, there was a protest in Montreal yesterday, and hundreds of people were arrested. In fact, some of them were arrested before the protest began.
Cops say that protesters committed acts of vandalism, throwing projectiles against buildings and targeting officers during the course of the afternoon.
The funny part is... marchers started tossing firecrackers and throwing vegetables at police. Cops asked businesses near the area of the initial gathering to keep garbage cans and other objects inside, just in case these idiots decided to use those objects as weapons.
Last year, 47 morons were arrested, ten restaurant windows were broken and one car was firebombed. Man, if my car were firebombed, I don't even know what I would do. But what I can tell you is... I love my car!
Ricky Hodgkinson unlawfully possessed a Taser when he shocked himself with a Taser.
Well, when he shocked himself, his lawyer said that he was a modern-day Homer Simpson when the incident occurred. Basically, when asked how he shocked himself, his lawyer compared him to Homer Simpson. He also said that it was during a "drinking session."
Cops found the during a search following a disturbance in the Dalaston area, near Walsall over in the United Kingdom. Hodgkinson admits to buying the device for "self defence."
"He told police he bought it for £100 from a friend," Jason Cordon-Bowen, prosecuting, told the court. "He said he was disappointed as he had tried it out on himself and was not in much pain at all."
So, he gets in trouble for having an illegal weapon, but still complains about how crappy the Taser is? He's an idiot. Tasers provide a good form of entertainment, according to Reverend Nathan Dutnall.
The Calgary Police Service has said that they don't need to follow the RCMP's decision to restrict the use of Tasers because they apparently already have strict policies in place regarding their use.
The RCMP announced on Thursday it has a new policy regarding the use of Tasers. Cops can no longer use them on resistant suspects.
The Calgary Police Service says it applauds the Mounties' move.
So, the title may have been cool... but it's very misleading.
The RCMP, or Royal Canadian Mounted Police will no longer be using Tasers against suspects who are resistant, according to RCMP Commissioner William Elliott.
Elliott said that it's still believed that the Taser is a useful weapon that saves lives, but that the RCMP now recognize that it can also cause death in "acutely agitated suspects." Damn it.
So, if a suspect is resistant, what are they going to do? Shoot the suspect? Oh, sure, that might be the solution... but the suspect may die... and virtually no entertainment to those and sick-and-twisted individuals out there, such as myself.
The Saskatchewan Police Commission decided that cops can't carry Tasers back in July of 2008. Well, that may change, as they will soon reconsider whether officers on the beat will be able to carry Tasers.
With four new members appointed by the Saskatchewan Party government last November, the five-person commission resolved at its first meeting last week to review that decision.
"Saskatoon police Chief Clive Weighill said last week he would like all front-line officers to carry the devices, which he said would help prevent the use of lethal force by police," according to the article I'm stealing to make this story. This would probably mean less shootings of "criminals" by the Saskatoon Police Service.
This announcement comes after Weighill recently announced that the public would be informed, should a Taser be used.
You know what's funny? When someone gets shot with a Taser, until they die. Then, it's just a shame. Anyway, the story today is... a father of a 14-year-old girl is suing the Ontario Provincial Police for $500,000 in damages after his daughter was shot with a Taser while inside a jail cell.
The girl was taken to hospital and treated for burn marks. No other injuries occurred.
Lawyer Jeff Robersts said the two officers used the energy device after the girl had been "sporadically peeling paint from the walls of her jail cell." If that's true, then it's awesome and the lawsuit would have no merit.
So far, none of the allegations have been proven in court.

Now, there's this story that makes me ashamed of some Edmonton Police Service officers... they are turning in their Tasers and won't be requesting another one.
The reason behind that story is because of the controversy they might create when using them.
Oh yeah... remember that Polish immigrant who died after being Tasered? Those cops are not facing any charges.

That's sweet. TASER International is a great company, and as a result, they should not be in any sort of trouble, because they have brought us many years of joyful entertainment. Every time a law enforcement official uses one of their devices, someone screams like a girl, resulting in hilarity.

Today, a Quebec coroner said that a Taser played no role in the death of an Italian man who was shocked with a Taser by cops in 2007.
However, Claudio Castagnetta did not receive proper medical care after the shock.
Claudio Castagnetta was arrested for public disorder on September 18, 2007 outside a convenience store in Quebec City. He was apparently walking barefoot and refused to leave the premises. Well, as much of a reason that is to shock the guy... maybe cops didn't understand something... maybe people walk around with no shoes in Italy?
Well, either way, I still stand behind the Taser when it is used.
Another person has died after being Tasered. This time, it was in Calgary.
That's a shame... really? I don't think so. If the douche didn't want to be subdued by a Taser, he shouldn't have been an ass when cops were trying to arrest him.
So what's the story?
Well, there was a call of "suspicious person." It later progressed to a break-and-enter.
Edmonton police were called to Dan's Pawn Shop in the city's west end yesterday at about 11:00 AM.
"The officers located the suspect in a store, where he was acting erratic, threatening the occupants and breaking windows," police spokesman Jeff Wuite said in a statement.
Breaking windows... that's a shame. I wonder if any automatic doors were damaged in the process.
As a result of the erratic behaviour, cops used the Taser twice, but it had no effect on the man at the time.
The man later ran AT the two officers. He was later wrestled to the ground and later arrested.
So as we've learned today, Tasers can't really kill anyone right away. People just die later, and it appears that it's not the result of the Taser. So as you can see, the Taser is harmless.
This is a story that you can only imagine. And if you can see it on video, then it becomes incredibly kick-ass. In fact, it's so kick-ass, it's hilarious!
A 16-year-old boy was trying to kick his father's ass with a knife. Yes... he got beat up too! But while trying to shiv his dad with a knife (I'm assuming), cops came and politely asked the teen to drop the knife. Still refusing, cops eventually used the Taser and it was used about five times. Still not successful, cops eventually took one of their cruisers and chased the teen and pinned him against a fence. Once that was done, cops kicked his knife out of his hand.
Eventually, the teen was arrested. Staff Sgt. Langford Bawn had this to say: "It's either that or shoot him," Bawn said. "You drive slow and do what you can do."
What a chicken... drive faster, hit him and shoot him too! Sheesh.
George Lochner is a 42-year-old man that was supposedly subdued by a Taser a total of seven times.
Lochner claims he was lying in his bed "harmlessly" when he was confronted by four Emergency Task Force officers.
His lawyer claims cops "Tasered Lochner without cause at least seven times while punching him in the face and the body." Well, true or not... that just sounds really, really funny.
Police claim that they were attacked by Lochner after they came to arrest his violent brother. I believe the police. He isn't the only crazy bastard that is suing the police force. His brother and mom is too.
You know what's funny? When a robber decides to rob someone, only to get shot himself.
That's what happened at an "East Stroudsburg" Wal-Mart store somewhere in America. The man was loading groceries into his vehicle and was robbed by a teen.
Joshua Eastman is a 28-year-old man that was about to be robbed at gunpoint. The man later took his gun and shot the 17-year-old robber, who turned out to be Reneau Jean Jacques.
What a douche. I wish I had a police baton... that would be good protection, and a good way to perform drive-by window smashings. Note: the guy in the picture is not the same guy.
In the Elkhart, Indiana area, police used a Taser on a 14-year-old after he was fighting with a 16-year-old.
The 14-year-old and the 16-year-old were having fun kicking each other's asses when police stopped the 14-year-old, who continued to hit the 16-year-old. It was then that cops decided to use the Taser on the 14-year-old.
Unfortunately, the 14-year-old student is still alive. Why isn't he dead? I thought Tasers were supposed to kill.
Another person in Winnipeg has been shocked by a Taser.
This time, the man didn't die.
Now, the cool thing is... after he got shocked, he fell on his head, which is funny, according to the nonsensical standards that we make up based on the time of posting.
